RC 118 Dt.21.5.16. Encashment of Half Pay Leave - Applicability of relevant Government Orders to Teachers for all managements

The attention of all the District Educational Officers and Regional Joint Directors of School Education in the State is invited to the reference 4th cited, and they are informed that Government have issued clarification orders on Encashment of Half Pay Leave and applicability of relevant Government Orders to Teachers working under all managements viz., Government, Panchayat Raj and Aided Institutions stating that all recommendations of Pay Revision Commission may not be accepted, due to the financial and other conditions in the State. Similarly, all the facilities extended to the Government employees may not be extended to the employees of the Panchayat Raj and Municipal Institutions. In addition to the financial constraints, the principal issue in this matter is that encashment of earned leave is not an entitlement. The Central Government employees are not allowed to encash earned leave until retirement. So, this benefit cannot be extended on par with regular Government Employees. 
 The Commissioner of School Education, Andhra Pradesh, Hyderabad is requested to file an appeal by clubbing all such cases (CAs/OAs) regarding applicability of Encashment of Hal Pay Leave to teachers working under Panchayat Raj Management and defend the case as stated above in C.A. No. 178/2016 in O.A. No. 6775/2014, dated 28.03.2016 filed by N. Narasimha Murthy, PSHM(LFL), MPP School, Munganda, P. Gannavaram Mandal, East Godavari District. Further Government also requested the Government Pleader for School Education, Hon'ble Andhra Pradesh Administrative Tribunal, Hyderabad/A.P. High Court, Hyderabad to enter appearance before the Tribunal/A.P. High Court respectively on behalf of the Government and defend the cases in the matter. This memo was issued with the concurrence of Finance (HR-IV) Department vide their U.O. No. 67600/70/HRIV/2016, dated 02.04.2016. 
Therefore, all the District Educational Officers/Regional Joint Directors of School Education in the State are requested to file the counters and appeals by incorporating above orders as and when this type of cases filed by the petitioners in Hon'ble Andhra Pradesh Administrative Tribunal/High Court of Andhra Pradesh, Hyderabad and defend the case with consultation of the LMC of this office and Government Pleader for School Education, Hon'ble Andhra Pradesh Administrative Tribunal, Hyderabad/AP High Court, Hyderabad respectively within the stipulated time. 
The District Educational Officer, East Godavari is requested to file appeal against the orders in C.A. No. 178/2016 in O.A. No. 6775/2014 filed by N. Narasimha Murthy, PSHM(LFL), MPP School, Munganda, P. Gannavaram Manda!, East Godavari District by incorporating the above Government Orders as per the reference 4th cited by consulting Legal Monitoring Cell of this office/Government Pleader for School Education, Hon'ble Andhra Pradesh Administrative Tribunal, Hyderabad and got interim suspension orders on above C.A. immediately.
